Mrs. Ghazala Waheed wo Abdul Waheed, Adult, Ro House No.***-*, DHA, Lahore Cantt, (hereinafter to as the LESSOR of the ONE PART).

And

Mr.* ***,Ro China, refereed to as the LESSEE of the OTHER PART.(Expression “LESSOR”

and “LESSEE” wherever the context so permit shall always mean and include their reective heirs, successors legal representative and assignees).

WHEREAS the LESSOR is the lawful owner and in lawful possession of House No,***-*,DHA,

Lahore Cantt, consisting of 4 Bedrooms with bath, DD,TV; Lounge, Kitchen, Store, Servant, Quarter together with fixtures and fitting (hereinafter collectively called the DEMISED PREMISES).

AND WHEREAS the LESSOR has agreed the lease and the LESSEE has agreed to take on lease the DEMISED PREMISES on the terms and condition as given below:-

1.This agreement in only valid if LESSEE is renewed and extended for the lease period.

2. The LESSOR lets LESSEE takes the DEMISSED PREMISES for a period of 2 months

八、甲方的责任:

8. 甲方须按时将出租房屋及其家私家具用品与其设施以良好状态交付乙方使用。

party a shall deliver on schedule to party bvacant possession of the leased property including the furniture,furnishing and appliances and the related facilities for party b’s use(furniture,furnishing and appliances to be detailed in appendisl.)

8.2 租赁期内甲方不得收回出租房屋(除非本合同另有规定),甲方保证乙方可不受干扰的享用该物业。

party a shall not repossess the leased property during the term of party a disturb of interfere with party b’s quiet enjoyment of the leased property.

8.3 在乙方遵守本合同的条款及支付租金的前提下,乙方有权于租赁期内拒绝甲方或其他人骚扰而安静享用出租房屋。

proviede that party b pays the rent and performs and observes party b’s terms and conditions in accordavce with this agreement, party b shall be entitled to hold and enjoy the leased property throughout the term of this tenancy without any interruption by party a or any other person.

8.4 租赁期内出租房屋的结构,进出物业的排水、上下管道、电路等处于良好使用状态。

party a agrees to repair and maintain the structure,drains, pipes and cables, etc.leading in to or from the leased property at all times in good and tenable repair during the term of this tenancy.

九、乙方的责任:

party b’s obligations:

9. 乙方应按合同的规定,按时支付租金,保证金及其他各项应付费用。

party b shall promptly pay all rent ,security deposit and other charges payable by it in accordance with the terms of this agreement.

9.2 乙方应爱护使用出租房屋,如因乙方的过失或过错致使房屋设施及屋内用具和饰品受到损坏(正常损耗除外),乙方应负赔偿责任。

paryt b shall treat the leased property with care. if as a result of party b’s negligence or misconduct, the leased property and the related facilities and accessorties suffer any damage(fair wear and tear excepted ),party b shall be reonsible for compensating party a for such damages.

9.3 乙方应按本合同的约定合法使用出租房屋,不得擅自改变使用性质,不应存放中华人民共和国法律下所禁止的危险物品,如因此发生损害,乙方应承担全部责任。

9.4 未经甲方事先书面同意,乙方不得将出租房屋转租或租给其他的第三者。

十、违约处理:

10. 1 甲、乙任何一方如未按本合同的条款履行,构成违约,应承担相应的违约责任。双方同意违约方应赔偿守约方之直接损失人民币____________元。

if either party a or party b fails to perform its obligations hereunder ,it shall constitute a breach of this agreement and the defaulting party shall be liable for the liabilities resulting from such breach. the parties agree that the party in breach shall pay the other party compensation ____________________for the direct loss and damage suffered by the other party as result of such breach .

10.2 乙方有下列行为之一的,甲方有权终止本合同,收回出租房屋,并且保证金不予返还;

a.未得甲方书面书面同意,将出租房屋擅自转租;

sublets the leased property without party a’s written consent;

b.未得甲方同意将出租房擅自拆改结构或改变用途的:

alters the structure of the leased property or uses the leased property other than for the purpose started herein without party a’s consent;

c.无故拖欠租金超过三天(除双方就本合同存在争议除外)。

fails to pay rent without any reason for more than thirty (30)days after the due date except where there is a diute in reect of this agreement.

十一、适用法律:

applicable law:

本合同的成立,其有效性、结实、签署和解决与其他有关的一切纠纷均应受中国法律的管辖并依据中国法律解释。

十二、争议的解决:

凡因执行本合同所产生的或与本合同有关的一切争议,双方应通过友好协商解决;协商不成,应提交中国国际经济贸易仲裁委员会,按其仲裁规则和中华人民共和国仲裁法进行仲裁。仲裁解决是终局的,对双方都有约束力。

第二篇:英文合同

this agreement of lease is made on this 16th day of december XX by and between:-

mrs. ghazala waheed w/o abdul waheed, adult, r/o house no.***-*, dha, lahore cantt, (hereinafter to as the lessor of the one part).

and

mr.* ***,r/o china, refereed to as the lessee of the other part.(expression “lessor”

and “lessee” wherever the context so permit shall always mean and include their respective heirs, successors legal representative and assignees).

whereas the lessor is the lawful owner and in lawful possession of house no,***-*,dha,

lahore cantt, consisting of 4 bedrooms with bath, d/d,tv; lounge, kitchen, store, servant, quarter together with fixtures and fitting (hereinafter collectively called the demised premises).

and whereas the lessor has agreed the lease and the lessee has agreed to take on lease the demised premises on the terms and condition as given below:-

1. this agreement in only valid if lessee is renewed and extended for the lease period.

2. the lessor lets lessee takes the demissed premises for a period of 12 months

commencing from 15th january XX. the lease is renewable for a further period as may be mutually agreed in writing on expiry of the lease period

3. the rent of the demised premises shall be usd3,300/-(us dollars three thousand and three hundred only) per month

4. the lessor hereby acknowledges receipt of the sum of usd.19,800/-(us dollars nineteen thousand and eight hundred only) per month.

6. that the lessor hereby acknowledges receipt of the sum of rs.60,000/-(rupees sixty thousand only) from the lessee as fixed edposit security which shall be refunded to the lessee on giving back the vacant possession of the demised premises after deduction of damages/shortages outstanding bills for electricity, water, gas and telephone charges etc, against the demised premises.

1. to pay to the lessor the rent hereby reserved in the manner before mentioned.

2. that the lessee shall not at any time during the terms, without the consent in writing of the lessor, pull down, damages or make any structure alterations to the demised premeses provided always, the lessee shall have go write install any fixtures and fittings excluding air-conditioners in the demised premeses, to detach and repossess the same subject to the restoration of the demised premeses to their original state at his cost (reasonable wear and tear excepted) on the expiry of this lease or any renewal hereof.

5. to pay regularly the bills for electricity, gas, water and telephone charges in respect of the demised premises. a copy of all the paid utility bill be forwarded to the lessor every three month regularly. in case of disconnection of any facility due to non-payment, lessee will be responsible to get them restored and pay the same. all dues must be cleared before the expiry of the lease.

6. the lessee shall keep and maintain the said premises in good and tenantable conditions during the tenure of the lease.

the lessor hereby convenants with the lessee as following:-

1. to pay all existing and future rate, taxes assessments and other charges of a public nature whether impose by the municipality, government or any other authority in respect of demised premises.

2. not to erect or set up a building or structure on the demises premises nor to add to any existing building or structure during the period of lease or any renewal without the written consent of the lessee.

it is hereby declear and muturally agreed between the lessor and lessee ans follwing:=

1. the lessee and the lessor shall have the right and option to terminate this lease at any time only after the expiry of the lease period i.e., 24 months, provided they give one (1) month notice in advance to either of the parties.

第三篇:房屋租赁合同甲乙双方

房屋租赁合同

出租方(甲方):身份证号码:承租方(乙方):身份证号码:甲、乙双方在平等自愿的前提下,就房屋租赁事宜协商一致签订本合同:

第一条、房屋坐落:甲方自愿将房屋出租给乙方。

第二条、租赁期限:从年月日到年月日止。

第三条、租金及支付方式

1、每月租金人民币元整;

第7条、续租的约定

房屋租赁期限届满,租赁合同终止,乙方需要续租,须在租期届满前30天提出,并经由出租人同意,从新签订合同。

第8条、租赁期间承租人转租房屋,必须征得出租人的同意,未经同意将房屋转租的,由承租人承担由此所引起的经济及法律责任。

第9条、违约责任

甲方未按本合同约定将房屋交付给乙方使用的,退还乙方所交款项并赔偿两个月的租金作为违约责任;甲方在租期内提前终止合同则退还乙方剩余租金,并承担两个月的租金及其他损失;乙方逾期缴纳租金,除补交所欠租金外,还必须以合同月租金的5%按日向甲方支付违约金;在租期内乙方提前终止合同,则向甲方支付两个月租金及其他损失。

1. 合同标的 1.1 产品概述

2. 合同价款及支付 2.1 合同价款

2.1.2 鉴于畜牧产品的生产因上游产品的价格经常浮动而导致产品成本经常处于波动状态,乙方理解甲方因此调整产品价格并不属于甲方的违约行为,但是甲方应该至少提前15天通知乙方。

2.1.3 甲方调整产品价格幅度在20%以内的,乙方同意无条件按照甲方调整后的价格予以接受,甲方调整产品价格幅度超过20%的,乙方接到甲方通知后,应在2天内以书面方式告知甲方是否接受,否则视为乙方同意接受甲方调整后的产品价格。如乙方不接受甲方的价格调整,则自甲方接到乙方的书面通知之日起,本合同自动终止。 2.2 货款的结算与支付

乙方在向甲方发出订单的同时,应将货款电汇至甲方指定账户。乙方采用汇票付款的,应将汇票通过特快专递或者专人送达等方式交付甲方。甲方收到汇票时,视为乙方履行了付款义务。

3. 订货与发货 3.1 订货方式:

3.1.1 乙方根据自身生产经营需要,向甲方发出书面订单(传真、邮寄、专人送达均可),订单应该记载明确乙方需要的产品品项、数量。甲方接到乙方订单后,保证一周内将货物发出。

3.1.2 鉴于畜牧行业生产周期长,畜牧产品需求具有特定时期或者阶段需求量大的特点,当甲方产品出现供不应求或者脱销的,甲方不能按照乙方要求足量、及时的向乙方供货时,乙方理解这种情形并不属于甲方的违约。 3.2 运输方式与交付地点 3.2.1 运输方式:冷链汽运。

3.2.2 乙方指定的甲方交付地点为: 。甲方因送货发生的陆运运费由甲方自行承担。

3.2.3 乙方要求空运时,甲方可代为空运发货。发往乙方指定交付地城市产生的空运运费,由甲方与乙方各承担50%,付费重量以机场提供的重量为标准。如乙方单次空运重量低于45公斤或乙方指定的交付地点较偏远,甲方无法将货物陆运送达,则空运费全部由乙方承担。

3.2.4 如乙方根据实际情况需要改变送货地点的,以乙方向甲方发出的书面订单所实际记载的送货地点为准。如乙方在订单上没有记载送货地址的,视为送货地址为3.2.2条指定的地址。甲方将货物送达至该地点后视为送货义务履行完毕。乙方未按时在该地点接收货物的,甲方或其送货人员可以以合理并且善意的方式处分该笔货物,该行为不免除乙方的付款责任。

3.3 乙方接收人员在送货单、收货单等有效单据上的签字或乙方在该等单据上的盖章行为,视为甲方完成交付义务。

3.4 在甲方将产品送达至乙方指定的地点之前,该产品的损毁、灭失等一切风险均由甲方承担,在乙方检验并在送货单上签字确认接收后,该风险始转移给乙方。

4. 检验及质量保证

4.1 产品在各地销售的入市检验费用由乙方承担,检验报告单归甲方所有。 4.2 乙方应在货到乙方指定地点后1小时内组织接受货物,并在2小时内验收完毕,验收时须有甲方承运的相关人员在场。

4.3 验收时乙方应查验货物的件数有无差异、包装是否破损、封箱贴是否完好。如果上述几点出现问题应在检验同时通知甲方客户服务部,在接货单上描述问题的实际情况,并让承运人签字。同时,乙方在收到货物时,要抽样检查质量,并做好记录。验收合格后,乙方应在收货单上签字确认,并视为甲方交付的货物质量合格。验收合格后,乙方提出的任何问题,甲方均不承担责任,但如乙方在验收后发现产品有验收时无法从外观上判断的质量瑕疵,可在完善保存产品同时,于验收后五日内向甲方提出。甲方接到乙方通知后按照客户投诉服务流程处理。

特别强调:甲方保证装货时产品每箱完好无损坏;如在接货时发现因运输过程中导致的货品外包装损坏、质量出现问题,乙方有责任协助甲方追究承运人赔偿责任。凡是在接收货物时发现的产品破损、数量不符或有异味,乙方应在验收和接收货物同时与甲方客户服务部联系,同时详细记录实际情况并让承运人签 3

字,作为甲方处理凭证。

4.4 对于乙方在转运、保存、使用等过程中引起的产品品质、外观发生的变化和质量问题,甲方不承担责任。

4.5 乙方因违反包括但不限于我国相关法律、法规,或者食品加工行业相关操作规范,或者一般条件下按照一般常识可以了解的操作守则,则由此导致的产品质量问题及事故,以及因此产生的责任与甲方无关。

4.6 在疑似因使用本合同项下之产品而导致的事故发生时,乙方有防止事故扩大的责任,并应及时将相关事宜通知甲方。

4.7 在出现甲方需召回合同项下产品的事由或者条件出现时,乙方应按照甲方的指示配合甲方召回相关产品。

4.8 对于乙方恶意或过错发生的退货或换货以及使用过程中给甲方造成的不良品牌及声誉影响时,甲方有权解除合同并要求乙方承担违约金贰万元,同时甲方保留通过法律手段追究乙方侵权或者其他责任的权利。

4.9 乙方采取自提方式接收货物的,乙方须与甲方工作人员共同验收货物并签字确认交接货物的品项、数量等内容,自行承担接收后的全部风险。

5. 违约责任

本合同对违约方的具体违约行为需承担的违约责任有约定的,按照约定执行。没有约定或约定不明确的,违约方应当承担守约方因违约方违约行为所造成的实际经济损失的赔偿责任,包括但不限于守约方因此需要向第三方承担的赔偿责任。

6. 保密和仿冒禁止义务

6.1 乙方承诺在履行合同过程中掌握的甲方的技术信息和经营信息,属商业秘密,乙方不得在任何时间、任何地点以任何方式向除本合同双方外的任何第三方泄露。同时,乙方不得侵犯甲方商业秘密、商业信誉和知识产权(包括但不限于品牌形象、专利权、商标权等),未经甲方同意不得为本合同以外的任何目的使用。

6.2 为了规范乙方正确的、合理的使用甲方专属商标、图片、照片、400电话 4

等资料信息,从而避免第三方纠纷或诉讼,保护甲乙双方利益,乙方在使用上述资料信息前应提交图样及使用方式和范围在甲方处备案授权,使用方式包括但不限于宣传品、橱窗门头、广告等。未经备案而擅自使用,须承担二十万元赔偿责任。合同到期未续约或解除后,乙方应立即停止使用,并在一个月内抹除、拆除、声明消除影响,否则视同侵犯甲方知识产权,须承担五十万元赔偿责任。 6.3 乙方必须以甲方品牌进行销售,不得冒用日本和牛或其他商标进行销售,也不得利用甲方的品牌销售其他厂家的产品;在其经营场所内,禁止一切方式的采用其他产品假冒、仿冒或者诱导消费者误解其他产品即为本合同项下产品的行为出现。否则,此种情况出现一次,乙方向甲方支付违约金人民币两万元,出现两次,甲方有权解除合同。如乙方违约金无法弥补甲方损失,乙方还应赔偿甲方因此造成的实际损失。

在解除合同后,乙方不得以任何方式体现或暗示其经营行为及其产品与甲方或者甲方的产品有关,否则甲方将追究其侵权责任。

7. 商品标签信息的统一和质量追溯验证系统的推广:

7.1 在未经甲方书面许可前提下,乙方不得擅自更改商品品名、包装、标签等任何内容和信息,否则一经发现视同乙方销售假货,乙方承担全部法律后果和责任。

7.2 为避免第三方纠纷或诉讼,保护甲乙双方利益。乙方切片、改刀、拆分礼盒等改变形态、重量等销售的,应当直接在新的最小销售单元不可分离的新标签上和销售凭证上如实标注原肉标签上标示的品名、等级、ID信息;加料调味后销售的产品可以自行决定在原品名前后缀以修饰词(不可拆分原名),但原肉等级和ID信息应在新的最小销售单元不可分离的新标签上和销售凭证上如实标注。如果乙方没有履行上述义务,导致第三方争议产品真伪性,从而发生纠纷或诉讼,乙方承担全部法律后果和责任。

7.3 乙方已经熟知甲方产品质量追溯系统和验证使用方法,也全面掌握了甲方产品分类、包装、标签、分切、分级等正品知识。乙方能够通过自身所积累的牛肉销售经验和上述追溯系统正确判断产品的真伪性。

8. 不可抗力

若一方因不可抗力事件而不能履行本合同所规定的义务,该方应在不可抗力事件发生后十四日内书面通知另一方,双方应尽其最大可能减少损失。若发生不可抗力事件,一方无需对因不能履行或损失承担责任,并且不视为对本合同的违约。遭受不可抗力的一方应采取适当的措施最大限度的减少或消除不可抗力的影响,并尝试恢复履行受影响的义务。

9. 附则

9.1 合同的修改和变更:对本合同或其附件的修改只可通过经双方授权的代表签署中文书面协议进行。

9.2 本合同任何条款的无效,不影响其它条款的效力。

9.3 本合同包括其附件构成双方之间就本合同所涉事项的全部协议,取代双方之前就合同事项达成的所有口头和书面的协议、合同、谅解和联系。各条款的标题仅为便于参阅而设,不具法律效力。

10. 其他

10.1 合同期满前,任何一方不再续签合同,应提前一个月通知对方。 10.2 合同双方在履行合同过程中发生争议的,双方首先应协商解决,协商不成时,可向甲方所在地人民法院提起诉讼。

10.3 本合同未尽事宜,经双方协商一致后,可另行签订补充协议,补充协议为本合同之有效组成部分。

10.4 本合同一式肆份,甲乙方各贰份,具有同等法律效力。 10.5 本合同自双方盖章或授权代表签字之日起发生法律效力。

第五篇:甲乙双方租赁合同

房屋租赁合同

1. 立合同当事人:

出租人:(以下简称“甲方”)

承租人:(以下简称“乙方”)

2. 租赁标的及用途:

甲方将位于乌鲁木齐市区路号室。

3. 租赁期限

租赁期限为年,自年月日起至年月日止。

若甲方未能于本条约定的起租日向乙方交付该房屋,则每逾期一日,甲方应按日租金的壹倍向乙方支付逾期违约金,直至甲方向乙方实际交付该房屋之日止,且起租日相应顺延,租赁期限不变。如甲方逾期未交房超过二十日,除应向乙方支付逾期违约金外,在未经乙方谅解的情况下视为甲方擅自终止租赁关系,甲方须按本合同第9条约定承担违约责任。

4. 租金

4.1 数额:每月元整)。

4.2 支付方式:租金按日前付清,以后每期租金 支付时间应为该期首月的日前。甲方应于收到每期租金的同时签署全额租金收据给乙方。

4.3如乙方逾期支付租金,则每逾期一日,乙方应按日租金的壹倍向甲方支付滞纳金。如乙方逾期超过二十日,除如数补交租金及滞纳金外,在未经甲方谅解的情况下视为乙方擅自终止本合同。

5. 租赁保证金

5.1乙方同意支付给甲方租赁保证金共计币元整)。 乙方应于交房当日或之前向甲方支付,甲方在收到租赁保证金同时应予以书面签收。

5.2除本合同另有约定之外,甲方应于租赁关系消除且在乙方将该房屋及其附属物品向甲方交割清楚,并付清所有 乙方应付费用当日将租赁保证金全额无息退还乙方。未经甲方书面同意,乙方不得以租赁保证金抵付租金等任 何费用。

6. 其他费用

6.1 租赁期限内,水费、电费、煤气费、电话(通讯)费、电视收视费、等房屋使用费由乙方承担,并按单如期缴纳。物业管理费由方承担,并按单如期缴纳。

6.2 乙方是否要求甲方提供合法有效之租金发票原件:□ 是,则租赁税由□ 否。

7. 甲、乙双方的权利、义务

7.1 甲方应保证该房屋及装修、附属设施、设备(详见附件)处于正常的可使用状态。若乙方发现该房屋及装修、附属设施及设备有损坏或者故障时,应及时通知甲方维修;甲方应在接到乙方通知后的七日内进行维修。逾期不维修的,乙方可以代为维修,费用由甲方承担。

7.2 租赁期限内,乙方应合理使用该房屋及装修和附属设施、设备。若由于乙方的不当或不合理使用,致使该房屋或其附属设施、设备毁损,乙方应负责维修。乙方拒不维修的,甲方可代为维修,费用由乙方承担。

7.3 未经甲方书面同意,乙方不得对该房屋进行装修、添附。经甲方书面同意后,乙方需要对该房屋装修、添附的,装修、添附的图纸和方案须征得甲方同意,且须符合该房屋所在地物业管理部门的要求及国家的相关装修要求;租赁期限届满时,甲、乙双方如不续租的,乙方在返还该房屋时有权将其对该房屋的装修、添附拆除,如不拆除,则视为乙方将该装修无偿赠与甲方。

7.4 甲、乙双方应当按照本合同的约定及时足额缴纳相关税、费,若甲方未能按时缴纳应付税、费的,乙方可以代为缴纳,并有权从租金中等额扣除;若乙方未能按时缴纳应付税、费的,甲方可以代为缴纳,并有权从租赁保证金中等额扣除,而后乙方应当于甲方书面通知后十五日内补足租赁保证金。

7.5 乙方应按本合同的规定,按时支付租金、租赁保证金及其他各项应付费用。乙方逾期不支付租金累计超过二个月的,甲方有权单方面解除本合同,并依据本合同第9条追究乙方违约责任。

8. 合同终止及解除

8.1 乙方如需在租赁期限届满后续租的,应在租赁期限届满一个月前书面通知甲方,甲方同意乙方享有同等条件 下的优先续租权。
